Just because a CFI lets his medical expire, doesn't mean he reverts to a "Flight Instructor with a Sport Pilot Rating". He's still a CFI with all the rights and privileges thereof (except he has to abide by the SP rules... i.e. no night flight, no flights above 10k).
Brian... your instructor falls into this category. All your training hours will count toward a PPL if you should decide to go that route.
Besides... it's a silly interpretation of the rules. Even the government bureaucracy will have to realize this, and reverse their decision. I trust NAFI, AOPA, and EAA will help the FAA come to a better, more logical interpretation.
