The ultralights are still exempt because they are ultralights.
It doesn't matter what engines the choose.  Same as gliders: no transponders required.
 
I think the reasoning is that these type of vehicles wouldn't likely be in the congested airspace anyway. And if they do operate in the mode-C they should be aware of it's existance and how to avoid it.

If the FAA wants to effectively remove the exemption they can easily do it by simply redefining the standards to an engine based definition. That would also make most ultralights even ones powered by industrial engines like B+S eligible

If we don't want ever moreonerous rules placed upon us, we have to impress upon our peers that thiscrap needs to stop. People need to know how to read a sectional and read abook and figure out how to share our airspace correctly or we will findourselves saddled with even more rules and requirements. How would anyonelike the rule to come down that everything that flies that weighs more than254# has to have a transponder? I wouldn't. Well guess what.... it's stufflike this that leads to that.Jim
