He stated he wanted to register it as an ELSA, of course he can't, but if it
met the standards of consideration as an ELSA it would of course be Sport
Pilot eligible.
He never gave any indication that it didn't, that was your opinion.
Either way he cannot take a finished aircraft and legally register it as a EAB
if it was partially completed he could probably finish it and still register
it as an EAB.
