The limitation on annuals is for part 23 aircraft regardless of if they qualify to be flown by someone who is an LSA pilot.
Because it qualifies to be flown as an LSA does not make a part 23 aircraft an LSA.
Same with EAB. You can build and set the operating limitations to LSA standards and be flown by an LSA qualified pilot.
